Justice – the Guardian of Liberty

There is a monster loose in America. It is a tyrannical monster whose perfidy grows every day. He is intelligent, educated at the most elite institutions and is holding some of the most powerful and prestigious positions in our land. He’s at his worst when all decked out in black. In the past month alone by means of its multitude of tentacles this monster has conducted a coordinated attack on the most ancient and most valuable of human institution, the one that pre-dates everything short of the first six days of creation.

It appears that the goal of this monster is to destroy God’s Holy institution of marriage, which is the core of family government, and family government in turn is the bedrock of civilization. In the founding of our land, there were some who assured us that this monster could be fully trusted, he was docile, with very little power we were told.

Alexander Hamilton, in Federalist 78, wrote, “Whoever attentively considers the different departments of power must perceive, that, in a government in which they are separated from each other, the judiciary, from the nature of its functions, will always be the least dangerous to the political rights of the Constitution; because it will be least in a capacity to annoy or injure them.” That assurance has proved hollow. Instead Thomas Jefferson was exactly prescient. “The judiciary of the United States is the subtle corps of sappers and miners constantly working underground to undermine our Constitution from a co-ordinate of a general and special government to a general supreme one alone. This will lay all things at their feet. … I will say, that against this every man should raise his voice, and, more, should uplift his arm …”

Thomas Jefferson saw in his day where judicial tyranny was leading. “When all government, domestic and foreign, in little as in great things, shall be drawn to Washington as the centre of all power, it will render powerless the checks provided of one government on another, and will become as venal and oppressive as the government from which we separated ….” Those words are sadly truer today in America than ever before.

I take Jefferson’s exhortation to us in our day “that against this every man should raise his voice, and, more, should uplift his arm.” How do we do that in America today, especially against the American Judiciary? We begin that battle by going back to the standard. As much as I admire the Founders, they are not the standard. God’s Word is the standard.

Turn to Exodus 18:13 where, in God’s Word, we are introduced to the rudiments of the Biblical standard of a good, honest and just Judiciary. We must start here, for if we don’t have the correct chart and compass, we cannot move in the right direction. Exodus 18:13-16 provides, “And it came to pass on the morrow, that Moses sat to judge the people: and the people stood by Moses from the morning unto the evening. And when Moses’ father in law saw all that he did to the people, he said, what is this thing that thou doest to the people? Why sittest thou thyself alone, and all the people stand by thee from morning unto even? And Moses said unto his father in law, because the people come unto me to enquire of God: When they have a matter, they come unto me; and I judge between one and another, and I do make them know the statutes of God, and his laws.”

Our chart and compass show us what judging should be about. Please note that Moses deserves admiration for his work. With 2 million people, as disputes arose, the people naturally looked to Moses, the man who spoke with God and to whom God had spoken; the man used by God to deliver them from bondage in Egypt. Now look at Moses’ workload. There were so many conflicts and disputes to resolve that it took from sun up to sun down and he still wasn’t done. Moses listened with care to each case, hearing both sides and rendering a decision which comported with God’s Law.

In his work Moses was trying to move the Children of Israel to adopt the Law of God in their own lives personally and in their whole society as a great nation. As disciples of Jesus Christ we are called to make judgments by the righteous standard of God’s Law given to us in God’s Word. Those judgments relate to all areas of life, even in the courtroom. For justice to be reestablished in our land, Christians must do what Moses was doing – teach others the Laws and Statutes of God.
