Massachusetts Drops Gag Order for Father of Justina Pelletier


We told you this week about the story of Justina Pelletier and how a Boston judge ruled to put her in a foster home following at least a year of her being removed from the custody of her parents. In that article I told you how the father, Lou Pellentier, was threatened with prosecution for violating a gag order in speaking about his daughter’s situation. Today, the motion to hold him in contempt of court was dropped.

The Massachusetts Department of Children & Families (DCF) broke their silence today, since the story has come to national news.

Massachusetts DCF spokesman Alec Loftus said, “Our primary goal has always been the health and well-being of Justina. We want the parents to be able to work with the providers and courts to ultimately move Justina back to her home state of Connecticut. That is the objective, and is consistent with our previous efforts to find an appropriate placement near her home. A medical team has been identified at Tufts, the family’s provider of choice, with the clinical expertise to care for Justina.”

However, this is nothing more than appeasing those who have voiced outrage at the overstepping of the state and Boston Children’s Hospital. Believe me, I’ve dealt with Child Protective Services, and this is how they operate.

Lou Pelletier isn’t buying the claims of DCF, and rightly so. He told The Blaze, “They have thrown more carrots out there over the last 13 months, dangling, teasing us, and that’s the cruelest thing you can do.”

“They throw out these carrots and these little teases just to string us along,” he said. “Actions speak louder than words.”

Mat Staver, one of the Pelletier’s lawyers with Liberty Counsel, agrees with my assessment about what took place with the story making the national spotlight and good people like those in this audience voicing their condemnation of how the state is handling things. “When [DCF] got challenged and it came to light, they decided to back off,” Staver said.

Justina was diagnosed years ago with mitochondrial disease, which causes loss of muscle control.

Last February, Justina got the flu and was taken to Boston Children’s Hospital. Since that time, she has not left the hospital.

Doctors determined that she had been misdiagnosed. Instead of mitochondrial disease, Justina has been diagnosed with Somatoform disorder, which is considered a mental disorder.

Her parents wanted to take their daughter home, but instead, were escorted by security out of the hospital. Four days later they found out they lost custody of their daughter.

They have been battling for their daughter ever since.

Mr. Pelletier believes that “DCF has destroyed my daughter,” and has “crossed the line so many times,” therefore, “we’re in it to win it.”

Mr. Staver said “We will not rest [until] DCF is completely out of this case, and DCF has to be held accountable for [its] neglegent actions.”

At least today the charges of contempt were dropped, leaving no reason for the scheduled March 24 hearing to take place. The next scheduled court hearing will be on March 17 to determine Justina’s custody status.

Friends and patriots, we cannot continue to allow this kind of tyranny from Child Protective Services. It is criminal and they know it, which is why they tried to silence Mr. Pelletier.
